Terms of Service

Last updated: October 15, 2026

These Terms of Service explain the rules for using Fitinty. We have tried to write them in plain language. Please read them, because they form a binding agreement between you and us.

1. Who we are

Fitinty is operated by Fitinty LLC, a Wyoming limited liability company, whose registered address is 1603 Capital Ave, Suite 413 C1040, Cheyenne, WY 82001, USA. In these terms, "Fitinty", "we" and "us" mean Fitinty LLC.

Fitinty is one platform for a business of any kind. It gives a business a workspace, a public storefront, and tools for things like courses, services, events, giving and ministries, farms, manufacturing, logistics and media. In these terms, "the Service" means the websites fitinty.com and app.fitinty.com, the storefronts that businesses host with us, and the tools inside them.

2. Agreeing to these terms

By creating an account, opening a business, or buying from or giving to a business on Fitinty, you agree to these terms. If you do not agree, please do not use the Service.

Two other documents also apply. Our Privacy Policy, published on our website at /privacy, explains how we handle personal information. Our Affiliate Disclosure, published at /affiliate-disclosure, explains our affiliate relationships. We refer to them here rather than repeat them.

If you have a separate written agreement with Fitinty that is signed by both of us, such as an Enterprise agreement, that agreement controls where it conflicts with these terms.

3. Who is who on Fitinty

A "business" is anyone who runs a shop, school, service, ministry, farm or other organisation on Fitinty. The person who opens the business is its owner. The people the owner invites to help run it are its staff.

A "customer" is anyone who buys from, books with, enrols with or gives to a business on Fitinty.

Fitinty runs the platform where businesses and their customers meet. When these terms say "you", they mean whichever of these you are. Some sections apply only to businesses or only to customers, and they say so.

The business, not Fitinty, is the one offering its products, services, courses, events or causes to its customers. Fitinty provides the tools. Fitinty is not a party to the sale, booking or gift between a business and its customer.

4. Who may use Fitinty

You must be at least 18 years old to open or run a business on Fitinty, or to be a member of a business's staff.

You must be at least 13 years old to be a customer, for example to buy, take a course or give. If you are under 18, you may use Fitinty as a customer only with the permission of a parent or guardian.

Nobody under 13 may use the Service.

If you act for a company or other organisation, you confirm that you have authority to accept these terms for it, and "you" then also means that organisation.

You may not use the Service if you are a person named on a sanctions list maintained by the United States or by another government that applies to you, or if you are located in, or ordinarily resident in, a country or region subject to comprehensive US sanctions or embargo. You may not use the Service to break export control or sanctions laws. You may not use the Service anywhere else the law forbids you to.

5. Your account

Give accurate information when you create an account, and keep it up to date. Keep your sign-in details secret. You are responsible for what happens under your account. If you think someone else has used your account, tell us straight away at support@fitinty.com.

If you own a business on Fitinty, you decide which staff can get into its workspace and what they can do there. You are responsible for what your staff do in your business's workspace, and for removing their access when they should no longer have it.

6. Plans and prices (businesses)

Our public price list currently offers four plans. Try is free: you can build your business, but you cannot open it to the public or sell. Starter costs US$29 a month. Business costs US$79 a month. Enterprise is priced by quote.

Prices are in US dollars. Where our billing partner applies regional pricing, the lower price is shown at checkout. Taxes are calculated and shown by our billing partner at checkout.

What each plan includes is described on our pricing page.

7. Your first go-live on Starter (businesses)

The first time a business goes live on the Starter plan, it pays US$1 a month for its first three months. After those three months, the Starter plan's normal monthly price applies, and the subscription keeps renewing at that price until you cancel.

Before your card is taken, we show you the full price and the date it begins. We email the business 7 days before the discounted period ends and the full price begins.

This offer is available once per business, ever. We record that a business has used it and we do not reset it, even if the business later closes, reopens or changes plan. A payment card is required to start it.

8. How your subscription is billed (businesses)

Fitinty's subscriptions are sold and billed by our billing partner, Dodo Payments, which acts as the merchant of record. This means Dodo Payments is the seller on your subscription payment and charges your card. Dodo Payments' own buyer terms, shown at checkout, govern that payment. Fitinty provides the Service you subscribe to. Billing questions can go to billing@fitinty.com.

At the date of these terms, subscription billing runs in test mode and no real money is charged.

Subscriptions renew automatically at the end of each billing period at the price then in effect, until you cancel. You can cancel at any time by writing to billing@fitinty.com from your account's email address, or with the cancel control on your billing page once it is available. When you cancel, your plan stays active until the end of the period you have already paid for, and it does not renew after that.

We do not give refunds for partial billing periods, except where the law requires a refund.

If we change a plan's price, we will tell the business owner by email at least 30 days before the new price applies. The new price applies from your first renewal after those 30 days. If you do not want to pay it, you can cancel before it applies.

9. Selling and receiving gifts through Fitinty (businesses)

A business can sell or receive gifts only on a paid plan, once it has gone live.

To take payments, a business connects its own account with a payment provider: Stripe or Paystack, depending on its country, and MonCash for giving in Haiti. That connection is between the business and the provider. The provider's own terms, checks and fees apply, and the provider, not Fitinty, processes the payment.

The money from your sales and gifts goes to your own account with your provider. Fitinty never holds your money.

You are responsible for refunds, disputes and chargebacks with your payment provider, and for the taxes on your own sales.

Card-network payments to and from Haiti are not available.

10. Fitinty's share of your sales (businesses)

For each sale a business makes through Fitinty, Fitinty keeps a share, taken as a platform fee through the business's payment provider. The share is paid by the business. It is never added to the price the buyer pays.

The share is: 2% of the sale on the Starter plan; 1% on the Business and Enterprise plans; 5% on any plan when the Fitinty Market brought the buyer, as explained in section 11; and 0% on donations and ministry giving. There is no cap.

We count only payments that are actually captured. A payment that is authorised but never captured carries no share.

Your payment provider's own processing fees are separate, and the provider charges them to you directly.

If you refund a sale, or a buyer's payment is reversed through a dispute or chargeback, Fitinty keeps its share, because it pays for the service already provided.

If we change these percentages, we will tell the business owner by email at least 30 days before the change applies, and you can cancel before it applies.

11. The Fitinty Market

The Fitinty Market lists offers from independent businesses. Every listing leads to that business's own shop. The business, not Fitinty, is the seller to its customer. A listing in the Market is not a recommendation or guarantee by Fitinty.

Listings are shown newest first, or ordered by verified reviews when a visitor chooses "popular". Fitinty may also feature listings.

A business can ask to be kept off the Market by writing to support@fitinty.com, and we will do so. Its own storefront stays live.

When a visitor follows a link from the Market to a business, a small first-party cookie called fitinty_market is set in that browser for 7 days. It holds only that business's page name. If that business makes a sale to the visitor in that browser during those 7 days, the sale counts as brought by the Market, and Fitinty's share on it is 5% instead of the plan's usual share. If the visitor later follows a Market link to a different business, the cookie is replaced by that business. This changes only Fitinty's share. It never changes the price the buyer pays. Our Privacy Policy describes this cookie.

12. A business's responsibilities to its customers (businesses)

If you run a business on Fitinty, you are responsible for what you offer and how you describe it; your prices; the taxes on your own sales; receipts and invoices; delivering what you sell; your own refund and cancellation terms; and answering your customers' questions and complaints.

You are also responsible for following the laws that apply to your business, for example consumer protection, product safety, food safety, licences and permits, and fundraising and charity rules. Fitinty's tools can help you organise your work, but using them does not by itself make your business compliant.

If you receive donations or ministry giving, you are responsible for telling givers truthfully how their gifts will be used and whether a gift is tax-deductible. Fitinty does not confirm the tax status of any business or gift.

If you collect information about your customers through Fitinty, you are responsible for having the right to collect it and for telling your customers how you use it, where the law requires.

13. How we handle your customers' information (businesses)

For the information about your customers that your business stores on Fitinty, Fitinty acts as your processor or service provider. This means that we process that information only to provide the Service to you and on your instructions, which you give by how you set up and use the Service. We keep it confidential, and the people who handle it are bound to keep it confidential.

We use other companies to help, such as our hosting provider, only under written terms that protect the information. We help you respond to requests from people who want to see, correct or delete their information. We tell you without undue delay if we become aware of a security breach affecting that information. When your business closes, we delete it, as described in section 23.

Our Privacy Policy explains how we handle the information we hold for our own purposes, such as your own account details.

14. Buying from or giving to a business (customers)

When you buy from or give to a business on Fitinty, your purchase or gift is with that business. Its prices, terms and refund policy apply. Your payment is processed by the payment provider that business has connected, and any refund comes from the business.

Questions about an order, a booking, a refund or a gift should go to the business first. If a business does not respond, you can write to support@fitinty.com. We may forward your complaint to the business, and we may act under these terms, but we cannot give a refund on the business's behalf.

Nothing in these terms limits the rights you have as a consumer under the law where you live.

15. Your content

Businesses create content on Fitinty, such as pages, products, courses, books, listings, images, audio and video. Anything else you put on Fitinty is your content too. Your content stays yours.

So that we can run the Service, you give Fitinty a worldwide, non-exclusive, royalty-free licence to host, store, copy, back up, process, format, translate when you ask us to, display and deliver your content. We use this licence only to provide the Service to you, including showing your published content publicly in the way you set it up, and showing your offers in the Fitinty Market unless you have asked to be kept off it. The licence ends when your content is deleted and the backups that hold it have expired. Backups are kept for up to 14 days and then deleted.

Content you publish is public in the way you configured it. Content you do not publish stays inside your workspace, subject to our Privacy Policy.

You promise that you have the rights to the content you put on Fitinty, and that it does not break the law or anyone else's rights.

We may remove or restrict content that breaks these terms or the law, or that we receive a valid notice about, as described in section 19.

16. AI drafts

Fitinty includes AI tools, which we call agents, that draft material such as posts, pages, translations and documents for a person to review.

A draft is only a suggestion. Nothing an agent drafts contacts anyone, charges anyone, sends, files or publishes on its own. A person approves each such action.

AI drafts can be wrong, incomplete, out of date, or similar to material made by others. Check every draft before you approve it, especially facts, prices, translations, and anything about law, health, money or safety. When you approve and publish a draft, it becomes your content and your responsibility.

We do not promise that an AI draft is accurate, that it is free of other people's rights, or that it can be protected by copyright.

Fitinty's AI runs on Fitinty's own machines. We never use businesses' or customers' content to train AI models. No content is sent to an outside AI company, unless a business itself chooses to connect an outside translation provider. In that case, the text the business sends for translation goes to that provider, under that provider's terms.

17. Fitinty's own property

The Service, including its software, design, and the Fitinty name and logos, belongs to Fitinty or its licensors. We give you a limited, non-exclusive, non-transferable right to use the Service under these terms, which ends when your access ends. You may not copy, sell or reverse-engineer the Service, except where the law allows it despite this term, and you may not use the Fitinty name or logos without our written permission.

If you send us ideas or feedback, we may use them without paying you or owing you anything.

18. What you may not do

You may not use Fitinty to break the law, or to offer anything that is illegal where it is offered or sold.

You may not use Fitinty to offer, sell or promote: weapons, explosives or ammunition; illegal drugs or drug paraphernalia; counterfeit or stolen goods; sexually explicit services; pyramid or Ponzi schemes; or unlicensed gambling, lending, money transmission, securities or other regulated financial services. You also may not offer anything that your payment provider prohibits.

You may not post or share any content that sexually exploits or endangers minors.

You may not deceive people, for example with fake reviews, fake causes, false claims about your products, impersonating someone else, or collecting passwords or payment details under false pretences.

You may not infringe anyone's copyright, trademark, privacy or other rights.

You may not harass or threaten anyone, or promote hatred or violence.

You may not send spam or phishing messages, or send messages to people who have not agreed to receive them where the law requires their agreement.

You may not upload malware or other malicious code, test or break the Service's security, try to reach another business's data, scrape the Service, or overload it.

You may not resell the Service without our written permission, or get around plan limits or the once-per-business go-live offer.

19. Reporting illegal content

To report content on Fitinty that you believe is illegal, write to legal@fitinty.com. Tell us where the content is, ideally with a link, and why you believe it is illegal. Include your name and email address, unless you are reporting content that sexually exploits minors, which you may report without them.

We review reports and act on them. When we remove or restrict someone's content or account, we tell that person what we did and why, unless the law or a safety reason prevents us. If you disagree with our decision, about your own content or about a report you made, reply to our message and we will review it again.

If you believe content on Fitinty infringes your copyright, send a notice to our designated copyright agent: Copyright Agent, Fitinty LLC, 1603 Capital Ave, Suite 413 C1040, Cheyenne, WY 82001, USA, email legal@fitinty.com.

Your notice must include: the copyrighted work you say is infringed; a link to, or clear description of where to find, the material you want removed; your name, address, telephone number and email address; a statement that you believe in good faith that the use is not authorised by the copyright owner, its agent or the law; a statement that the information in your notice is accurate and, under penalty of perjury, that you are the owner or are authorised to act for the owner; and your physical or electronic signature.

If your content was removed after such a notice and you believe that was a mistake, you can send a counter-notice to the same agent. It must include: the material that was removed and where it appeared before; a statement, under penalty of perjury, that you believe in good faith that it was removed by mistake or misidentification; your name, address and telephone number; a statement that you consent to the jurisdiction of the federal district court for the judicial district where your address is located or, if your address is outside the United States, any judicial district in which Fitinty may be found, and that you will accept service of process from the person who sent the original notice or that person's agent; and your physical or electronic signature. If we receive a valid counter-notice, we will send a copy to the person who sent the original notice, and we may restore the material in 10 to 14 business days unless that person tells us they have started a court action.

We will close the accounts of people who repeatedly infringe others' copyrights, in appropriate circumstances.

21. Outside providers

Parts of the Service rely on, or connect to, services run by other companies, such as our billing partner, the payment providers businesses connect, and other tools you choose to connect. Their own terms apply to their services. We are not responsible for their services, and if a provider changes or stops a service, a Fitinty feature that depends on it may change or stop too.

22. Features that are not live, and changes to the Service

Some features you may see in Fitinty are previews or simulations, including anything that would move real money beyond test mode, connect to a broker, file taxes, or provide regulated financial services. They do not do those things for real, and we do not offer them as live services unless and until we announce that they are live.

Nothing in the Service is legal, tax, financial, investment or medical advice.

We keep improving Fitinty, so features may be added, changed or removed. If a change significantly reduces what a paid plan includes, we will tell the business owner at least 30 days in advance, unless the change is needed for legal, security or safety reasons.

We work to keep the Service available, but we do not promise that it will always be available or free of errors. We may need to pause it for maintenance or for reasons outside our control.

23. Closing your account, and suspension

You can close your account, or your business, at any time by writing to support@fitinty.com. For requests about your personal information, write to privacy@fitinty.com.

We may suspend or close your access, or close a business or its storefront, if you break these terms, if the law requires it, if a payment you owe is not made, or if your use puts customers, other users or the Service at risk, for example through fraud. We will tell you at least 30 days before we suspend or close a business, explain why, and give you a chance to fix the problem. We may act immediately, and will tell you why, where the law requires it, in an urgent case, for a serious or repeated breach of these terms, or where there is a risk to others.

When a business is closed, its storefront goes offline. Owners can download their contacts and products as CSV files from the workspace's Data page at any time, so please do this before closing. Other records are provided on request within 30 days after closing. After that, we delete or keep information as described in our Privacy Policy and as the law requires. Amounts already owed remain owed.

Sections 10, 13, 15 (for content still on the Service or in backups), 17, and 24 to 29 continue to apply after your account is closed.

24. Disclaimers

To the extent the law allows, the Service is provided "as is" and "as available". We do not promise that it will meet your particular needs, and we make no warranties beyond those stated in these terms or required by law, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.

We do not promise any business results, such as sales, bookings, gifts or traffic from the Fitinty Market. We are not responsible for what a business offers, says or does, or for whether it delivers what it sells.

If you are a consumer, this section does not affect the rights the law gives you.

25. Limits on our liability

To the extent the law allows, Fitinty is not liable for indirect, incidental, special, consequential or punitive losses, or for lost profits, revenue, data or goodwill, arising from or related to these terms or the Service.

To the extent the law allows, Fitinty's total liability for all claims arising from or related to these terms or the Service is limited to the greater of the amount you paid Fitinty in the 12 months before the claim and US$100.

Nothing in these terms limits or excludes liability that cannot be limited or excluded by law, such as liability for death or personal injury caused by negligence, for fraud, or under consumer protection laws that cannot be set aside by contract.

26. Your promise to cover claims (businesses)

If you run a business on Fitinty, you will defend Fitinty against claims brought by someone else that arise from your content, your products or services, your sales, or your breach of these terms, and you will pay the losses and reasonable legal costs that result from those claims.

For this to apply, we will tell you promptly about the claim and cooperate reasonably with you. You control the defence, but you may not settle a claim in a way that admits fault by Fitinty without our consent.

This section does not apply to customers acting as consumers.

27. Disputes and the law that applies

If you have a problem with Fitinty, please write to legal@fitinty.com first. We will try to resolve it with you informally. Neither of us will start a court case until 30 days after that written notice, except for a small-claims case or a request for urgent relief from a court.

These terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-law rules. Disputes will be decided by the state and federal courts in Laramie County, Wyoming.

These terms do not require arbitration and do not waive your right to take part in a class action. Anyone may bring a claim in a small-claims court that has jurisdiction.

If you are a consumer, you keep the protections that the law of the country where you live gives you and that cannot be set aside by contract. If you are a consumer in the European Union or the United Kingdom, or anywhere else the law gives you this right, you may also bring a claim in the courts where you live.

28. Changes to these terms

We may update these terms. If a change is material, we will tell you at least 30 days before it takes effect, by email to the account's address and on our website or in the workspace. Other changes take effect when we post them. The "Last updated" date at the top shows when these terms last changed.

If you keep using the Service after a change takes effect, you accept the updated terms. If you do not agree to a change, you can stop using the Service and close your account before it takes effect.

29. General

Fitinty is available in 44 languages, and these terms may be translated. The English version controls. Translations are provided for convenience, except where local law requires otherwise.

These terms, together with the documents they refer to, are the whole agreement between you and Fitinty about the Service. If any part of these terms cannot be enforced, the rest still applies. If we do not enforce a term straight away, we have not given up the right to enforce it later.

You may not transfer your rights or duties under these terms without our written permission. We may transfer ours as part of a merger, sale or reorganisation, and we will tell you if we do.

We are not responsible for delays or failures caused by events outside our reasonable control.

We may send you notices by email or in the workspace, and you agree to receive them electronically. Formal legal notices to Fitinty must be sent to legal@fitinty.com and to Fitinty LLC, 1603 Capital Ave, Suite 413 C1040, Cheyenne, WY 82001, USA.

Only you and Fitinty can enforce these terms. Nobody else has rights under them.
